Can photos of members of the Royal House be used for commercial purposes?
No. The courts have repeatedly ruled that this is not permitted. These rulings are based on image rights, as defined in sections 19 to 21 of the Copyright Act (AW 1912) and the fundamental right to respect for one’s privacy.
NB: This is slightly different to the protection of privacy of members of the Royal House as defined in the media code. The media code states that it should be up to members of the Royal House, rather than other parties such as the tabloid weeklies, to decide what and when photographs taken at events and occasions belonging to their private lives may be published.
